Traffic Safety & Driving Laws

Helmet Laws

  • Motorcycles – All riders 17 years old and younger must wear a helmet.
  • Bicycles - All riders under 16 years old must wear a helmet.
  • Motor Scooter - Helmets are required for all riders 17 years old or younger.

Mobile Electronic Device (Cell Phone) Ban

All of the State of Hawaiʻi counties have enacted distracted driving laws. Avoid the use of electronic devices while driving.

Distracted Walking Law (Oʻahu only)

In Honolulu it is illegal, with few exceptions such as dialing 911, to cross the street while using with your phone or other device. Texting while walking in a crosswalk can result in fines up to $99.

Hawaiʻi’s Child Passenger Restraint Law

Hawaiʻi state law requires that all children under age 4 be restrained in a federally approved child safety seat. Children ages 4 through 7 ride in a booster seat or car seat any time they are in a vehicle. The only exceptions are for children taller than 4’9” or those riding in vehicles with lap-only seat belts in rear seats. Driver’s not in compliance can be fined up to $500.

Seat Belt Law

Hawaiʻi state law requires that all front and back seat motor vehicle occupants, both children and adults, buckle up at all times while driving. Driver’s not in compliance can be fined up to $112.
